TERMS AND CONDITIONS

1 CONDITIONS OF CONTRACT

(a) Ozjet carries passengers on flights in Australia on conditions that consist of the following:

  • The OzJet general conditions of carriage
  • A copy of the said conditions of carriage are available on request from OzJet 1300 737 000 or at the OzJet website at www.ozjet.com.au
  • These terms and conditions
  • The applicable laws and international conventions
  • Directions issued by OzJet staff from time to time
In the event of any inconsistencies in these terms and conditions the general conditions of carriage shall apply.

(b) A person must present a valid OzJet Airlines ticket and / or a boarding pass to be carried on a flight. Mutilated or damaged tickets (or boarding passes) can in certain circumstances be replaced by OzJet. Tickets are not transferable and are generally valid for one year after issue.

(c) OzJet will use its efforts to carry you and your baggage in accordance with the date and time specified but does not guarantee it will be able to do so. Schedules may change from time to time at short notice. OzJet may, without notice, substitute alternate carriers or aircraft and may alter or omit transiting ports on the ticket in the case of necessity. OzJet assumes no responsibility for making connections.

(d) The contract between you and OzJet, including any exclusion or limitation of liability, applies to the benefit of OzJet employees, agents and representatives.

(e) Passengers must comply with Government travel requirements, present exit, entry and other required documents and arrive at airports by times fixed by the carrier, of if no time is fixed, early enough to complete departure procedures.

2 BAGGAGE

Passengers are permitted the following;
Checked baggage (aircraft hold) – 30 Kilograms (Business class passengers)
Checked baggage (aircraft hold) – 20 Kilograms (All other passengers)
Cabin baggage (onboard the aircraft) – 7 Kilograms *

* 4 Kilogram limit applies for services to Denpasar

An additional allocation of 10 kilograms per person will be permitted for sporting equipment; e.g. bowls, surfboards (height restrictions), golf clubs.

PLEASE NOTE – Excess baggage charges will apply and carry-on per items must not exceed 105 linear centimetres.

The following items shall also be carried free of charge: Infant carry basket, wheelchair (fully collapsible); crutches or other like device if you are dependent on such a device.

OzJet can refuse to carry baggage which will endanger the aircraft or person on the aircraft, or offend the Dangerous Goods Regulations or baggage which is prohibited by other regulations from being carried on an aircraft. Passengers should not include fragile or precious items, or valuable business documents and other like items in checked baggage. Dangerous goods can be considered as explosives, all types of gases under pressure, flammable liquids and solids, organic peroxides and oxidisers and all types of toxic substances, corrosive substances and radioactive material. There are some items that by their nature may be acceptable. Please refer to the relevant section under “Flying with OzJet” and if in doubt contact OzJet before packing any dangerous goods in baggage.

OzJet may refuse carriage of baggage that does not comply with the general conditions of carriage or may refuse to carry an item because of its size, weight, shape or contents. For reasons of safety and security OzJet may request the passenger to permit a search to be made of their baggage.

In the case of checked baggage OzJet will provide a bag identification tag and requires all such baggage to be clearly labelled with the identity of the passenger. After arrival at the destination the passenger is required to collect baggage as soon as practicable and shall produce the baggage check or other suitable means of identification.

2.1. OzJet will not be liable for loss or damage to or delay in the delivery of fragile or perishable items, money, jewellery, precious metals, securities, passports, title deeds, artefacts, manuscripts or other valuables (including but not limited to cameras, videos, laptops and other electronic equipment) which are included in the passenger’s checked baggage whether with or without the knowledge of OzJet. Valuable items should be carried on your person or in your carry-on baggage and under your care. If the aforementioned items are checked in as baggage, passengers agree that those items shall be at their own risk.

2.2. Notwithstanding the restrictions outlined in 2.1 above, OzJet shall be liable for damage to checked baggage only if such damage has been caused by the negligence of OzJet subject to applicable limitation provisions.

2.3. OzJet will be liable for baggage subjected to and as provided by the Civil Aviation (Carriers Liability) Act, 1959, as amended and any other relevant legislation.

2.4. OzJet’s liability for loss or damage is limited to AUD $1600 per passenger for checked baggage and AUD $160 per passenger cabin baggage. There shall be no liability for delay of baggage.

2.5 Any claim for damage to checked baggage or cabin baggage shall be made within 3 days of receipt of the baggage in relation to an item contained in the baggage and 21 days in the case of loss or damage to the whole of an item in the checked baggage.

3 CANCELLATION OR CHANGE OF SCHEDULE

If due to circumstances beyond its control OzJet cancels or delays a flight or is unable to provide a previously confirmed space, OzJet shall either carry the passenger on another of its scheduled passenger flights on which space is available or make a refund of the cost of the ticket, and shall be under no further liability to the passenger.

4 LIMITATION OF LIABILITY

Carriage wholly within Australia, which is not international as defined by the Warsaw Convention, is subject to the provisions of the Civil Aviation (Carriers Liability) Act, 1959, as amended and complementary State legislation.

OzJet’s liability in respect of death or injury of any passenger is limited to AUD $500,000. However OzJet shall not be liable for any injury, illness or disability including death which is attributable to your physical or mental condition or the aggravation of any such condition.

If the passenger’s journey involves an ultimate destination or stop in a country other than the country of departure the Warsaw Convention or the Montreal Convention may be applicable and these Conventions govern and may limit the liability of carriers for death or bodily injury and in respect of loss of or damage to baggage.

5 SEARCHES

OzJet, Government or Airport officers may require you to submit to clothing or body searches; require you to submit your baggage to searches or inspections and search or inspect your baggage with or without you.

6 RIGHT TO REFUSE CARRIAGE

OzJet reserves the right to refuse carriage to any person who seeks to travel in violation of the applicable law, or general conditions of carriage, or under the influence of drugs or alcohol, or if it is necessary for the safety or comfort of other passengers or for the protection of property.

7 CONTAGIOUS DISEASES

In accordance with the Civil Aviation Orders and the duty of care to protect passengers and crew, OzJet will not carry passengers with a contagious disease while they are infectious.

A medical certificate or letter from a physician stating that the passenger “is not suffering from a communicable disease at the contagious stage” is required before travel can be approved for the following contagious conditions:

  • Chicken pox
  • Shingles
  • Hepatitis A
  • Measles
  • Mumps
  • Rubella (German measles)
  • Whooping cough (Pertussis)
  • Tuberculosis
